Tapestry Contract

Data protection law in the EU (known as the GDPR) mean we need to have a contract with you that lays out how we work together.

We have released a new version of the contract in April 2019. The changes in this are minor. The most important ones are:

  1. We say that a forthcoming register function means you might, if you wish, be storing attendance data.
  2. We say that the new Tapestry apps mean that you might, if you wish, be sending push notifications. Those notifications would go via Apple, Google or Amazon (depending on the device) and might go outside of the EU.
  3. We say that we have changed email provider for our billing and customer support from Fastmail to Zoho Mail.

A full list of changes is contained on the last page of the contract.

You can download the Tapestry Online Learning Journal Contract 2019-04-18.pdf

You can see a PDF with changes from the previous version marked.

You will be asked to digitally sign the new contract from within Tapestry.

If you have any questions, please send them to contract-feedback@eyfs.info.

Questions

Can I see my current contract?

You can always find your current contract by logging in as a manager to the web version of Tapestry, clicking on your name on the top right, clicking control panel. The contract is listed under the 'contracts' section which should be at the bottom of the left bar.

Where do I find out more about the GDPR?

For those in the UK, you can find out more at The Information Commissioner's Office. For those in other EU countries, there should be an equivalent organisation listed on the European Commission website.

The actual GDPR law is laid out by the European Commission at http://ec.europa.eu/justice/data-protection/reform/index_en.htm.

I am not based in the EU, does this apply to me?

The GDPR applies to us, because we are based in the EU, and all nurseries, schools, childminders, educators, and similar educational organisations who are based in the EU or who store data in Tapestry about people who are in the EU.

We currently treat all our customers equally. If you think this will cause a problem in your country, please let us know.

Can you fill out the form issued by my local authority?

To keep costs down we don't do bespoke contracts, or fill out forms on your behalf. But to help schools that have been issued guidance or standard contracts by their local authority for GDPR compliance. To help those schools, below are notes that explain where to find the relevant clauses in our contract or, if the clauses aren't there, why not.

  • Hampshire schools: download our note on "Data Protection Contract Clauses for Schools" written by the “Governance and Information Law Team, Hampshire Legal Services” and dated October 2017.
  • Derbyshire schools: download our note on "Variation Agreement - General Data Protection Regulations (GDPR)".
